Grievances & Requests

Requesting the use of frozen funds or assets to cover basic and exceptional expenses

  • Funds and assets frozen due to the National List:

Any individual or entity listed in the national list, or his representative, may submit a written request to the Technical Committee for the Implementation of Security Council Resolutions for accessing all or part of the frozen funds by filling out and attaching a request form to use the frozen funds or assets to cover necessary, basic and exceptional expenses, along with all documents supporting the application and sending it to the email of the Technical Committee (Sanctions@amlu.gov.jo).

The Technical Committee approves a request to use the frozen funds of an individual listed in the national list in the following cases:

  1. To cover necessary or basic expenses, such as the amounts payable for foodstuffs, rent, mortgage, medicine, medical treatment, insurance premium, educational and judicial fees, and public utility fees.
  2. To pay professional fees and costs relating to rendered legal services and other exceptional expenses within reasonable limits, or services relating to safekeeping or management of frozen funds
  3. Exceptional expenses if and as approved, on a case-by-case basis, by the Technical Committee.

After studying the request, its reasons, and the amount of funds requested, the Technical Committee may decide to reduce it or reject the request based on justified reasons.

  • Funds and assets frozen due to the UN Sanctions Lists:

Any individual or entity designated by a Security Council sanctions committee, or its representative, may submit a written request to the Technical Committee for the Implementation of Security Council for accessing all or part of the frozen funds by filling out a request form to use the frozen funds or assets to cover necessary, basic and exceptional expenses, along with all documents supporting the application, and sending it to the email of the Technical Committee (Sanctions@amlu.gov.jo).

Basic Expenses:

  1. To cover necessary or basic expenses, such as the amounts payable for foodstuffs, rent, mortgage, medicine, medical treatment, taxes, insurance premiums, educational and judicial fees, and public utilities fees.
  2. To pay professional fees and costs relating to rendered legal services and other exceptional expenses within reasonable limits, or services relating to safekeeping or management of frozen Funds

If the request is related to basic expenses and if the technical committee approves the request after studying it, the technical committee must notify the UNSC or the Sanctions Committee of its intention to approve the submitted application. In case the Sanctions Committee does not object or issue a decision of rejection within five (5) business days, Technical Committee may order that the approved amounts of funds are unfrozen and the entity holding the frozen funds shall be immediately notified in writing to such effect and asked to implement the decision and advise the Technical Committee of the actions taken in this regard.

However, if the request is related to exceptional expenses that are different from the expenses mentioned in the Basic Expenses section above, and if the Technical Committee is satisfied with the request after studying it, the Technical Committee must notify the relevant Sanctions Committee of its intention to approve the application submitted to obtain the written approval of the Sanctions Committee.  The Technical Committee may not approve it except after obtaining written approval from the Sanctions Committee. That is, in the absence of written approval, the Technical Committee does not approve the application.

Grievance against the listing decision

  • Delist a listed person on the National List

Any individual or entity listed in the national list may personally, or through his representative, submit a grievance request to the Technical Committee for the Implementation of Security Council Resolutions to remove his name from the national list by filling out a grievance form against the decision to be listed in the national list, attaching it with all supporting information and documents and sending it to the email of the Technical Committee (Sanctions@amlu.gov.jo).

The Technical Committee studies the application in accordance with the procedures stipulated in the instructions. If the Technical Committee approves the submitted application, the name will be removed from the national list. The Committee will notify the applicant, the reporting entities, the competent authorities, and any other person or entity to lift the freeze on funds and economic resources. However, In the event of rejection, the applicant will be notified in writing of this, along with the reasons for the rejection. In all cases, the person harmed by the rejection decision has the right to resort to the competent administrative court.

  • Delist a listed person on the UN Sanctions Lists

Any individual, entity, or group designated by the UNSC can submit a request for removal from the UN Consolidated List to the applicable UNSC Sanctions Committee, following the procedures for submitting de-listing requests pursuant to each UNSC Sanctions Committee.

Individuals, entities, or groups designated in UNSC Sanctions Lists can submit de-listing requests directly to the Focal Point for De-listing (except for designated individuals, entities, or groups inscribed on the list of the 1267/1989/2253 Committee (“the ISIL (Da'esh) and Al-Qaida Sanctions List”). Designated individuals or entities seeking to de-list from the Security Council’s ISIL (Da'esh) and Al-Qaida Sanctions List must submit their petition to The Office of the Ombudsperson.

The request for removal can also apply for:

  • A deceased individual; or
  • An entity that no longer exists.
